Terms and Conditions of Sale – RetreatBooking

 

1. Scope

These Terms and Conditions of Sale govern online bookings for retreats organized by Samyay Empresa Individual De Responsabilidad (“Yana Samyay”), located in Písac, Peru. By booking a retreat through our website (https://yanasamyay.com), the client agrees to theseterms.

2. Booking and Payment

Bookings are made online via our website using Paypal and any debit-credit card
To secure a place, the client must pay either the full amount or a deposit, as indicatedon the booking page.
● Payments are processed via secure online payment systems. The client is responsiblefor any bank or transfer fees.
 

3. Confirmation

The booking is considered valid once the payment has been received and a confirmation email has been sent to the client.

4. Cancellation by the Client

Cancellations must be notified in writing (by email: info@yanasamyay.com).
Refund policy:
All retreat payments are non-refundable. This is because we reserve accommodations, facilitators, and logistics in advance. If you have a genuine emergency and cannot attend, you may transfer your booking to a future retreat (subject to availability).

Cancellation less than 15 days before the retreat → no refund.

Deposits, if required, are non-refundable unless otherwise stated.
 

5. Cancellation or Modification by the Organizer

In case of unforeseen circumstances (minimum participants not reached, natural disaster, force majeure, illness), Yana Samyay reserves the right to cancel or reschedule the retreat. In such cases, the client will be offered A credit to attend a future retreat.

6. Liability

Participation in the retreat is voluntary and under the client’s own responsibility.
The retreats do not replace medical or psychological treatment. Clients must inform the organizer of any health conditions before booking.
The organizer is not responsible for accidents, loss, theft, or damage to personalbelongings.
 

7. Data Protection

Personal data collected during booking is used solely for administrative and organizationalpurposes. Data is processed in accordance with GDPR.

8. Applicable Law

These terms are governed by Peruvian law. Any disputes shall fall under the jurisdiction of the courts of Cusco, Peru.

9. Non-refundable Services
Please note that some services, such as official entrance tickets (e.g., Machu Picchu), train or bus tickets, and certain hotel reservations made through third-party providers, are strictlynon-refundable. These amounts cannot be reimbursed under any circumstances once the booking is confirmed.

10. Consumer Rights in Peru
In accordance with the Peruvian Consumer Protection and Defense Code (Law 29571), ourguests have the right to file a claim or complaint before INDECOPI (Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual), the competentauthority in Peru for consumer protection.
